ICC Provisional Measures

Subject: Request for Provisional Measures – Protection of Children Affected by TCDD (Agent Orange)


To: Office of the Prosecutor, International Criminal Court


Dear Prosecutor,


I respectfully request that the Court consider Provisional Measures under Articles 68 and 75 of the Rome Statute in relation to my Article 15 communication lodged on 1 July 2025.




Context



This case concerns systemic and ongoing harm caused by TCDD (dioxin/Agent Orange). The effects are intergenerational, producing birth defects, chronic illness, and denial of care to the children and grandchildren of Vietnam veterans and affected civilians.



Aiding and abetting under Article 25(3)(c) of the Rome Statute applies to corporations, insurers, and financial actors who knowingly concealed liabilities and profited from the continued denial of remedies for TCDD harm.





Urgency



The harm is ongoing and irreversible. States, corporations, and insurers have been formally notified and remain silent. Each day of delay exposes new generations to preventable suffering and entrenches systemic denial.




Requested Provisional Measures



Pending final determination, I respectfully request that the Court order:


  • Screening and Care: Immediate toxic-exposure screening and access to medical treatment for children of Vietnam veterans and their descendants.

  • Record Recognition: Amendment of medical records to reflect inherited TCDD exposure, preventing further misclassification.

  • Public Acknowledgement: Formal notification by governments of known risks, consistent with UN treaty body findings.

  • Corporate Transparency: Disclosure of liabilities associated with TCDD harm by Dow, Bayer, insurers, and related entities in ESG and investor reporting.

  • Non-Retaliation: Protection for those raising claims, including from denial of care, reprisals, or intimidation.





Legal Basis



  • Rome Statute: Articles 68 & 75 (protection of victims; reparations).

  • ICJ Statute: Article 41 (provisional measures – persuasive authority).

  • UNCRC: Articles 6 & 24 (rights to life, survival, and health).

  • Stockholm Convention: Articles 5 & 10 (duty to identify, notify, and remediate persistent organic pollutants).

Closing



Silence cannot shield states or corporations from their obligations. Urgent provisional measures are necessary to prevent further irreparable harm while proceedings are pending.

A formal complaint has been lodged with the International Criminal Court for Crimes against Humanity. The final submission was the 1st of July 2025.



Australia ratified International treaties but failed to implement them into domestic laws.



When the United Nations tells you 8+ times you are breaking the law, YOU ARE BREAKING THE LAW. Stockholm Convention & Agent Orange is a chemical war crime against children.
