ASIC Enforcement

Dear ASIC Enforcement Team,


I am notifying you of serious governance and disclosure breaches by the four major Australian banks – ANZ, Commonwealth Bank of Australia, Westpac, and National Australia Bank.


Each bank was formally put on notice regarding:


  • Binding obligations under the Stockholm Convention on Persistent Organic Pollutants, and

  • More than eight United Nations warnings (2011–2021) concerning inherited TCDD/Agent Orange harm and second-generation impacts.



I issued deadlines of 7 August 2025. As of 19 August 2025, none of the banks have provided any substantive disclosure. Responses have been limited to automated acknowledgements or silence.


This raises grave concerns under the Corporations Act:


  • Continuous disclosure obligations – investors have not been informed of material risks tied to treaty breaches, UN warnings, and potential insurance fraud.

  • Governance failures – repeated silence and missed deadlines demonstrate systemic disregard for lawful obligations.

Request: I ask ASIC to investigate whether these banks have breached their disclosure duties to shareholders and the market, and to consider enforcement action.


Silence in the face of legal obligations and UN warnings is not compliance — it is concealment.


If ASIC fails to act by 29 August 2025, this silence will be annexed into my International Criminal Court (ICC) and United Nations Convention against Transnational Organised Crime (UNTOC) submissions as further evidence of systemic regulatory failure.

Australia ratified International treaties but failed to implement them into domestic laws.

Thank you for contacting the Australian Prudential Regulation Authority (APRA).

APRA’s role is to supervise authorised deposit-taking institutions (ADIs), such as banks, building societies and credit unions, as well as insurance companies, including private health insurers, and superannuation funds, to promote the prudent management of these financial institutions.


Secrecy provisions contained in the Australian Prudential Regulation Authority Act 1998 prevent APRA from disclosing information relating to the supervision of a particular regulated institution. Consequently, APRA is unable to provide the information you have requested.

Dear APRA,


Thank you for your reply.


Secrecy provisions under the APRA Act 1998 do not extinguish Australia’s binding obligations under international law. Eight separate United Nations treaty bodies have already found Australia in breach of its obligations, including under the Stockholm Convention, the Convention on the Rights of the Child, and the Convention on the Rights of Persons with Disabilities.


Your acknowledgement that APRA supervises banks, insurers, and superannuation funds confirms jurisdiction. Failure to address systemic non-disclosure of treaty breaches, crimes against humanity, and insurance fraud therefore constitutes regulatory complicity, regardless of domestic secrecy clauses.


This correspondence will be annexed to my case before the International Criminal Court under Article 15 of the Rome Statute. Silence or reliance on secrecy provisions will not shield APRA from being recorded as having been formally notified and refusing to act.
