Dear Mr Southalan,
I am writing to formally re-engage with the AusNCP regarding my May 2025 specific instance (Dow Inc and Bayer AG / Monsanto).
Since the closing of the matter as “withdrawn”, the UN Special Rapporteur on toxics and human rights has issued a clear public statement on toxic remnants of war, explicitly warning that toxic releases from military activities threaten the rights to life, health, water, food, and a healthy environment for both current and future generations, and that accountability is hindered by military secrecy, immunity, and causation barriers. This is directly relevant to the core public-interest issues my complaint raised: intergenerational harm, long latency, disclosure failures, due diligence, remediation, and access to remedy. The Special Rapporteur further identifies the need for baseline environmental data, advanced monitoring, and effective remedies such as clean-up and compensation. (OHCHR)
With that in mind, I am requesting the following:
1) Re-engagement and procedural correction
Please record that I am re-engaging in good faith and request that AusNCP support the matter being progressed in a Guidelines-consistent way, rather than remaining closed on a procedural characterisation.
2) Transfer/coordination pathway
If AusNCP maintains the view that the appropriate lead NCP is the United States, I request you action the transfer/coordination steps promptly and provide me written confirmation of the transfer status and what information will be provided to the lead NCP.
3) Statement of purpose
This request is made to progress corporate responsibility and remedy under the OECD Guidelines framework. It is not a request for AusNCP to determine government responsibility.
Given the UN expert’s statement, the continuing relevance of toxic remnants of war to human rights, and the acknowledged barriers that victims face, I ask that you treat this as an immediate re-engagement notice and respond in writing with the next procedural steps.
