complaint is under Australian criminal law & int obligations from Australia’s ratification of: The Rome Statute of the Int Criminal Court The UN Convention on the Rights of Persons with Disabilities (CRPD) The UN Convention on the Rights of the Child (CRC) The Stockholm Convention on Persistent Organic Pollutants (POPs) I am a second-generation victim of TCDD (dioxin) exposure from Agent Orange. My doctor confirms access to my father’s military pension, service, and medical history is essential to my healthcare. The DVA’ refuses to release this, claiming no records exist after 2006. This denial is life-threatening. It has caused preventable medical deterioration, financial harm, & trauma. The UN has formally warned Australia at least six times since 2014 for failing to uphold obligations to disabled persons, toxic exposure victims, and veterans’ children, including: 2014 CRPD Concluding Observations 2016 Report by UN Special Rapporteur on Toxics 2019 CRC Concluding Observations 2020 UPR recommendations 2021 CEDAW findings 2024 Special Rapporteur report on military-related toxics 1. Rome Statute – Crimes Against Humanity Under Article 7(1)(k), “intentional infliction of conditions of life” causing serious harm may constitute a crime against humanity. Australia’s systemic refusal to acknowledge chemical warfare inheritance, release records, or honour entitlements contributes to physical injury, suicide risk, and untreated illness. 2. UN CRPD Violations Article 25 Equal access to health care. Article 4 Eliminate discrimination in service provision. Article 31 Collect and share disability-related data. Australia has failed to collect any data on children of exposed veterans and denies us essential records, breaching Articles 25 &31. 3. UN CRC Violations Article 6 Right to life and development. Article 24 Obligation to combat disease. Article 3 Best interests of the child. Australia failed to protect, warn, or support the children of Vietnam veterans. My current condition stems from congenital harm that was foreseeable and neglected. 4. Stockholm Convention (POPs) TCDD is listed under Annex C. Article 6(1)(e) requires states to identify and remediate contaminated sites. The Orica case (2011–2013) involved far lower toxicity, yet triggered enforcement. No such accountability exists for ADF/DVA’s TCDD exposures—despite known generational harm. 5. Domestic Precedent – Robodebt Robodebt showed state negligence, harm automation, and avoidable death. What’s happening to veterans’ children is worse—no review, no remedy, no recognition, despite evidence.
