Banks Referal to APRA

Subject: Formal Referral – Major Banks’ Non-Disclosure and Missed Deadlines (Treaty & UN Warnings)


Dear APRA,


I am referring the following banks for prudential oversight review:


  • ANZ

  • Commonwealth Bank of Australia (CBA)

  • Westpac Banking Corporation

  • National Australia Bank (NAB)



Each bank was formally notified of:


  • Documented treaty breaches under the Stockholm Convention on Persistent Organic Pollutants, and

  • More than eight United Nations warnings to Australia (2011–2021) regarding inherited TCDD/Agent Orange harm.



Despite these notices, the banks:


  1. Failed to disclose any response or substantive information to me when directly asked.

  2. Missed the formal deadline of 7 August 2025 for engagement, and again failed to reply substantively by the final reminder of 22 August 2025.



For transparency, I have published a record of all communications, notices, and acknowledgements on my website and blog:

This site contains the full correspondence history, including banks’ automated replies and missed deadlines.


Their silence is now part of the evidentiary record. This raises clear prudential concerns:


  • If such risks were not disclosed to their insurers/reinsurers, their cover may be void or contested.

  • Failure to acknowledge or escalate these matters internally suggests deficiencies in risk governance and disclosure obligations.



I request that APRA:


  1. Confirm whether these four banks have reported these matters to APRA as material risk events.

  2. Confirm whether APRA will initiate supervisory review of their disclosure and governance processes in light of the missed deadlines and non-responses.



Please acknowledge receipt and provide a reference number for this referral. APRA’s response (or lack thereof) will be annexed to my ICC submission and related filings.

Australia ratified International treaties but failed to implement them into domestic laws.
