Subject: Failure of APRA to Enforce Prudential Standards and Disclosure Obligations


Dear Basel Committee Secretariat,


On 21 August 2025, the Australian Prudential Regulation Authority (APRA) formally acknowledged its supervisory role over banks and insurers, but refused to act on the systemic non-disclosure of material liabilities tied to eight separate United Nations treaty body findings and the Stockholm Convention. APRA invoked secrecy provisions under the APRA Act 1998 to avoid scrutiny or enforcement.


This reliance on secrecy law directly conflicts with the Basel Core Principles for Effective Banking Supervision, particularly those on disclosure, supervisory responsibility, and systemic risk oversight. By refusing to enforce disclosure of treaty breaches and UN findings, APRA is enabling regulated institutions to trade under false pretences, creating systemic prudential and market integrity risks.


Request:


  1. That the Basel Committee record this notification and alert the Group of Central Bank Governors and Heads of Supervision (GHOS) of APRA’s supervisory failure.

  2. That BCBS remind APRA of its obligation to enforce standards consistent with the Basel Core Principles, regardless of domestic secrecy laws.
