Subject: Notification of Supervisory Failure – Australian Prudential Regulation Authority (APRA)
Dear Members of GHOS,
On 21 August 2025, the Australian Prudential Regulation Authority (APRA) acknowledged its jurisdiction over banks and insurers but refused to act on the systemic non-disclosure of material liabilities tied to eight United Nations treaty body findings and the Stockholm Convention. APRA invoked secrecy provisions under the APRA Act 1998 to avoid scrutiny or enforcement.
This reliance on domestic secrecy law directly conflicts with the international supervisory standards established by the Basel Core Principles for Effective Banking Supervision and the Insurance Core Principles (IAIS). By failing to enforce disclosure of treaty breaches and UN findings, APRA is enabling regulated institutions to trade under false pretences, creating systemic prudential and market integrity risks.
Request for Action:
That GHOS record this notification as evidence of supervisory failure by APRA.
That GHOS remind APRA of its obligations to enforce Basel and IAIS standards, regardless of domestic secrecy provisions.
That GHOS consider the reputational and systemic implications of continued supervisory inaction within its membership.
