ICC Portal Submission

Dear Office of the Prosecutor,

I am submitting this communication to request that the International Criminal Court (ICC) investigate systemic crimes against humanity committed by the Australian Government regarding second-generation harm caused by exposure to 2,3,7,8-Tetrachlorodibenzo-p-dioxin (TCDD), a toxic compound in Agent Orange. This harm, experienced by the children of Vietnam veterans, including myself, has been systematically ignored by Australian authorities, despite extensive evidence and international scientific consensus.

Evidence Supporting the Claim:

Medical Documentation: My health conditions, confirmed by medical professionals, directly correlate with second-generation TCDD exposure.

International Research: Multiple studies from the World Health Organization and U.S. Institute of Medicine confirm intergenerational harm from TCDD.

Government Knowledge: Australia has long been aware of the risks posed by TCDD, as documented in reports and correspondence.

Rejection of Care: Despite repeated requests to the Department of Veterans’ Affairs (DVA), Centrelink, Queensland Health, and other health agencies, care and support have been denied. Queensland Health, specifically, has ignored requests to investigate the link between my conditions and TCDD exposure, representing a clear example of systemic neglect.

Legal Basis under the Rome Statute:

The actions of the Australian Government fall under the following Rome Statute Articles:

Article 7(1)(k) – Inhumane acts causing suffering or injury

Article 7(2)(a) – Widespread or systematic attack against civilians

Article 25 – Individual criminal responsibility

Article 28 – Command responsibility

Article 30 – Mental element (intent)

Prime Ministers: John Howard, Kevin Rudd, Julia Gillard, Tony Abbott, Malcolm Turnbull, Scott Morrison, Anthony Albanese.

Ministers for Veterans’ Affairs: Danna Vale, De-Anne Kelly, Alan Griffin, Michael Ronaldson, Darren Chester, Andrew Gee, and others.

Queensland Health: Systematic neglect by Queensland Health in failing to provide care or investigate the impact of TCDD exposure on second-generation victims.

Conclusion:

This failure to act constitutes a clear violation of human rights and international law. I urge the ICC to investigate these crimes against humanity, as outlined in the Rome Statute. The Australian government’s refusal to address this issue, despite access to evidence and resources, continues to cause harm to affected individuals and their families.
