Tēnā koe Danielle,

I refer to your email below, copied to this Office, in which you raise concerns about the conduct of the Solicitor-General, Attorney-General, and two lawyers at MFAT.

Unfortunately, an Ombudsman has no authority to consider your complaint. This is because section 13(7)(c) of the Ombudsmen Act 1975 explicitly excludes “any decision, recommendation, act, or omission of any person acting as legal adviser to the Crown…” from an Ombudsman’s jurisdiction.

In addition to pursuing your concerns through other avenues and international bodies, you may also wish to contact Veterans’ Affairs to discuss what entitlements or support may be available. There is more information on this page of their website (and related links).

Subject: RE: Jurisdictional Limitation – Noted

Kia ora Kent,

Thank you for confirming that the Ombudsman’s Office will not act on matters involving the Solicitor-General, Attorney-General, or Crown legal advisers. That limitation is noted.

However, I would point out that Lloyd’s of London does not insure treaty breaches or crimes against humanity. The issues I have raised — including breaches of the Rome Statute, the Stockholm Convention, and related obligations — are not “policy disagreements” but violations of binding international law, with direct financial and insurance consequences for the Crown and its banking/insurance partners.

This means that ignoring these breaches does not remove liability — it simply leaves the costs uninsured and payable from domestic funds.

That risk is now on record internationally.

Nāku noa,

A formal complaint has been lodged with the International Criminal Court for Crimes against Humanity. The final submission was the 1st of July 2025.

Australia ratified International treaties but failed to implement them into domestic laws.
