Subject: Urgent Escalation – Ongoing Care Failures, Legal Concerns, and Compensation


Dear Meg,


I am writing to raise urgent concerns regarding my care and support within the regional health system, which continue to cause me significant distress and worsening health outcomes.

Had I been informed of these congenital abnormalities in 2011 by Dr XYZ in 2019 by Dr XYZ or as recently as April 2024 by the ENT specialist, I could have made the connection much earlier to my father’s military service in Vietnam and the well-documented risks of TCDD (Agent Orange) exposure. With that knowledge, I would have recognised the likely cause of my complex health issues, begun early advocacy, sought accountability from the Department of Veterans’ Affairs, and potentially prevented the severe deterioration and trauma I now live with.

Additional key concerns include:

I have formally submitted a complaint to AHPRA regarding the negligence of Dr XYZand Dr XYZ who failed to properly diagnose and manage my spinal and congenital conditions. Their inaction has severely impacted my wellbeing over many years.

An ENT doctor also neglected to inform me about critical birth defects involving missing middle ear bones and bilateral superior semicircular canal dehiscence, visible on scans. This failure has delayed diagnosis and treatment, causing profound stress and confusion.

Despite repeated verbal requests for mental health support, I have been informed that no Social Worker will be available at my appointment tomorrow, and alarmingly, there is no record of my requests in the medical notes. This lack of documentation and follow-through is actively worsening my trauma-related symptoms and represents a clear failure in care coordination.

These ongoing failures appear to constitute breaches of:

The Civil Liability Act 2003 (Qld) – failure to exercise reasonable care and skill

The Health Practitioner Regulation National Law Act 2009 (Qld) – unprofessional conduct and failure to meet expected standards

The Human Rights Act 2019 (Qld) – particularly my rights to health care, dignity, and protection as a disabled person

I have already submitted a formal request for compensation for the avoidable deterioration in my physical and mental health caused by these systemic failings and omissions.

Given the severity of these issues, I now urgently request your office to:

Investigate why my repeated requests for mental health support and access to a Social Worker have not been documented or fulfilled

Ensure that appropriate social work support is available during and after my next appointment.

Clarify what remedial actions your office will take to address these breaches of duty of care and the lasting impact on my wellbeing

Provide clear information about the compensation process in light of the significant harm I have suffered

These matters are also being documented in domestic complaints and international legal submissions, including a case lodged with the International Criminal Court for 1 July 2025 concerning systemic failures to address second-generation harm from toxic military exposure.

I appreciate your urgent attention and request a written response outlining the steps you will take to resolve these ongoing failures in care and accountability.
